What Constitutes DUI in Mississippi?

Under Mississippi law, you can be charged with driving under the influence if you operate a motor vehicle while impaired by alcohol, drugs, or a combination of both.

In most cases, a driver is legally intoxicated if their:

  • Blood Alcohol Concentration (BAC) is 0.08% or higher

Lower limits apply if:

  • You hold a Commercial Driver’s License (CDL) (0.04%)
  • You are under 21 (0.02% under Mississippi’s zero-tolerance law)

Importantly, you can still be arrested and charged even if your BAC is below the legal limit if an officer claims you were “impaired.”

Third DUI Offense

  • 1 to 5 years in prison
  • $2,000 to $5,000 in fines
  • Up to 5 years license suspension
  • Mandatory IID

Can You Refuse a Breath or Blood Test?
