What Constitutes Domestic Violence/Simple Assault?

However, certain circumstances can result in harsher sentencing, such as having prior convictions or committing a crime because of the victim’s actual or perceived gender, religion, national origin, ethnicity, race or color. 

When Is Domestic Violence/Simple Assault a Felony?

While domestic violence or simple assault is typically a misdemeanor, crimes committed against certain individuals (“special victims”) can lead to felony penalties. These parties include:

  • Judges
  • Teachers 
  • Firefighters
  • Social workers
  • Correction officers
  • Certain court employees
  • Public school administrators
  • Law enforcement officers
  • Emergency medical personnel
  • Legislators or other elected officials
  • Adults over the age of 64 who are incapacitated or have a disability
  • Family protection workers employed by the Mississippi Department of Human Services (MDHS)

When simple assault is committed against a special victim, the crime becomes a felony punishable by up to five years in prison and $1,000 in fines. When simple assault or domestic violence is committed against a pregnant woman and results in fetal harm, the penalties increase significantly. You may also be required to pay up to $5,000 in restitution to the victim for any expenses resulting from the crime, such as medical treatments, counseling, and repair or replacement of damaged property.
